Real Estate Lending And Finance

Our firm’s lending and finance practice group has a well-known reputation for consistently meeting and exceeding the goals and expectations of our lending and finance clients. Drawing on our extensive real estate and business law backgrounds, we have effectively represented a broad range of clients, including both lenders and borrowers. We understand the importance of comprehensive review of each transaction and the deal points and legal issues involved, but also strive to facilitate a cost-effective closing in a timely manner.

Our attorneys frequently handle a wide range of both conventional and complex transactions, including acquisition loans, construction loans, development loans, refinance loans, mezzanine loans, bridge loans, securitized loans and multistate/multiparcel cross-collateralized loans. Our legal representation encompasses the careful review, analysis and negotiation of all documents and aspects of the financing transaction, including the commitment letter, loan documents, borrower’s entity documents (including the preparation and/or restructuring of corporate organizational documents and resolutions), guarantees and indemnities, public records searches, title review and other due diligence matters, and ultimately, when representing borrowers, the drafting and issuing of a legal opinion. We are very familiar and routinely work with many nationally and regionally recognized mortgage bankers and title companies to ensure that every step of the due diligence process is completed properly, and that any potential issues with the financing or property are addressed.

As the lending environment continues to change, we remain committed to providing our clients with the advice and legal representation they need in order to assist them in maximizing the value of their assets.
